Terms of Service

These Terms govern access to SignalPost. By creating an account, purchasing a plan, or using the service, you agree to them on behalf of yourself and any organization you represent.

1. Accounts and authority

You must provide accurate information, be legally capable of entering this agreement, and have authority to bind the organization using the account. You are responsible for workspace users, credentials, API keys, integrations, and all activity under your account.

2. Permission-based email only

You may send only lawful messages to recipients you are permitted to contact. Purchased, rented, harvested, scraped, guessed, appended, or deceptively obtained addresses are prohibited. You must maintain evidence of consent or another lawful basis when required and promptly honor unsubscribe, deletion, and suppression requests.

3. Sender identity and message requirements

You must use accurate sender and routing information, a valid reply address, truthful subject lines, required disclosures, and a working unsubscribe mechanism. You are responsible for compliance with CAN-SPAM, GDPR, UK GDPR, CASL, state privacy laws, consumer-protection rules, and other laws applicable to your recipients and campaigns.

4. Prohibited conduct and content

You may not use SignalPost for spam, phishing, malware, credential theft, impersonation, fraud, illegal products or services, unlawful discrimination, harassment, threats, exploitation, deceptive claims, privacy violations, infringement, evasion of sanctions or export controls, or content that creates a material risk to recipients, SignalPost, our providers, or other customers.

You may not probe or disrupt the service; bypass limits or safeguards; conceal the origin of traffic; create accounts to evade a restriction; resell access without permission; use automated means that impose unreasonable load; or upload data you lack authority to process.

5. Deliverability and platform protection

You must maintain reasonable list hygiene and complaint, bounce, and engagement levels. We may inspect sending patterns, metadata, complaint signals, imports, and content to detect abuse and protect shared infrastructure. We may throttle, block, quarantine, require remediation, disable a sender or integration, or pause campaigns when activity threatens deliverability or platform integrity.

6. Suspension and termination

We may suspend or restrict access immediately when we reasonably believe your use violates these Terms, creates legal or security risk, harms deliverability, threatens recipients or third parties, exposes SignalPost or a provider to liability, involves fraud or unauthorized payment, or could materially disrupt the service.

We may terminate an account immediately for serious or repeated violations, attempts to evade enforcement, failure to cooperate with an abuse investigation, use after suspension, or activity that cannot be safely remediated. For other breaches, we may provide an opportunity to cure, but are not required to do so where delay could cause harm.

You may terminate by canceling the subscription and discontinuing use. Upon termination, your right to access the service ends. We may delete account data after a reasonable wind-down and retention period, subject to backups, legal holds, fraud prevention, billing records, and applicable law. You should export needed information before termination.

7. Fees, renewals, and refunds

Paid plans renew monthly unless canceled before renewal. You authorize applicable recurring charges, taxes, and usage-based amounts displayed at purchase or in your account. Except where law requires otherwise or SignalPost states otherwise in writing, fees are nonrefundable and unused allocations do not roll over.

8. Customer content and responsibilities

You retain ownership of your content and data. You grant SignalPost and its providers the limited rights needed to host, process, transmit, secure, and display that content to operate the service. You represent that your content, data, instructions, and use do not violate law or third-party rights.

9. Third-party services and AI features

Integrations, delivery providers, payment services, stock media, and AI providers may have separate terms and may change or become unavailable. You are responsible for reviewing generated content, personalization, audience selection, and campaign settings before sending. SignalPost does not guarantee that generated output is accurate, unique, lawful, or suitable.

10. Service changes and availability

We may modify, add, limit, or discontinue features and may perform maintenance. We do not guarantee uninterrupted or error-free operation, specific delivery, inbox placement, revenue, engagement, or availability of third-party systems.

11. Disclaimer and limitation of liability

To the maximum extent permitted by law, SignalPost is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, noninfringement, or guaranteed results. SignalPost is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost goodwill, or campaign performance.

To the maximum extent permitted by law, SignalPost’s aggregate liability arising from the service will not exceed the amount you paid to SignalPost during the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so those limitations apply only to the extent permitted.

12. Indemnification

You will defend, indemnify, and hold SignalPost and its personnel harmless from third-party claims, losses, penalties, and reasonable costs arising from your content, contact data, campaigns, products, violations of law, infringement, or breach of these Terms.

13. Changes and survival

We may update these Terms. Material changes will be posted with a new effective date and may be communicated through the service. Continued use after the effective date constitutes acceptance. Provisions concerning payment, ownership, disclaimers, liability, indemnification, enforcement, and data retention survive termination.

14. Contact and abuse reports

Questions and suspected abuse may be reported to support@signalpost.email. Include relevant message headers when reporting suspected spam, but do not send passwords or unnecessary sensitive data.
